1. Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of femPAQ Health, operated by femPAQ Inc. (“femPAQ,” “we,” “us,” or “our”). By creating an account or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use femPAQ Health.
2. Description of Service
femPAQ Health is a personal health tracking application that helps users monitor menstrual cycles, symptoms, maternal health, perimenopause, and fertility journeys. The App generates a Pre-Visit Health Report that users may choose to share with their healthcare provider. femPAQ Health is a wellness tool, not a medical device.
3. Not Medical Advice
femPAQ Health is not a substitute for professional medical advice, diagnosis, or treatment. The information and reports generated by the App are for personal wellness tracking and informational purposes only. Always seek the advice of a qualified healthcare provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay seeking it because of something you read in the App.
In an emergency, call 911 or your local emergency number immediately.
4. Eligibility
You must be at least 13 years old to use femPAQ Health. Users under 13 may only use the App with verified parental consent, as required by the Children’s Online Privacy Protection Act (COPPA). By creating an account, you represent that you meet these eligibility requirements.
Parents who create accounts on behalf of children under 13 are responsible for ensuring the child’s use of the App complies with these Terms.
5. Account Registration and Security
You agree to provide accurate, complete, and current information when creating your account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at privacy@fempaq.com if you suspect unauthorized access to your account.
femPAQ reserves the right to suspend or terminate accounts that violate these Terms.
6. Your Health Data
You own your health data. femPAQ Health stores your data solely to provide the App’s features. We do not sell your personal health data to third parties. Your data is used in accordance with our Privacy Policy.
You may export or delete your data at any time via the Account settings in the App. Deletion is permanent and cannot be undone.
7. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or in violation of these Terms
- Attempt to gain unauthorized access to any part of the App or its infrastructure
- Interfere with or disrupt the App or servers connected to it
- Use automated tools to scrape, crawl, or extract data from the App
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity
- Upload or transmit harmful, offensive, or illegal content
- Circumvent any security or access controls
8. Share Links and Provider Access
When you generate a share link for your Pre-Visit Report, you grant the recipient a temporary, read-only view of that report. Share links expire after 7 days. You may revoke a share link at any time. femPAQ is not responsible for any use a recipient makes of your shared report after you have voluntarily shared it.
9. Subscriptions and Billing
femPAQ Health offers a free tier and optional paid subscription plans. Paid subscriptions are billed through Stripe. By subscribing, you authorize femPAQ to charge your payment method on a recurring basis at the selected interval until you cancel. You may cancel your subscription at any time via Account → Manage Subscription.
Refunds are not provided for partial subscription periods unless required by law. femPAQ reserves the right to change subscription pricing with 30 days’ notice.
10. Intellectual Property
The App and all its content — including but not limited to text, graphics, logos, and software — are the property of femPAQ Inc. and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any content without our express written permission.
Your health data and the reports generated from it belong to you. femPAQ does not claim ownership over your personal health information.
11. Research and Equity Data Program
Users who opt into the femPAQ Equity Data program consent to the use of anonymized, de-identified health data for women’s health research. Participation is voluntary and can be withdrawn at any time via Privacy Center. Anonymized data already used in published research cannot be retroactively removed.
Users enrolled in the Lafayette County femPAQ Health Study (LAF school code) consent to the sharing of aggregate, de-identified study data with the Lafayette County Health Unit pursuant to grant requirements.
12. Disclaimer of Warranties
femPAQ Health is provided “as is” and “as available” without warranty of any kind. To the fullest extent permitted by law, femPAQ disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or completely secure.
13. Limitation of Liability
To the maximum extent permitted by applicable law, femPAQ Inc. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the App, even if femPAQ has been advised of the possibility of such damages.
femPAQ’s total liability to you for any claims arising under these Terms shall not exceed the amount you paid to femPAQ in the 12 months preceding the claim, or $50, whichever is greater.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via in-app notification or email at least 14 days before the changes take effect. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App and may delete your account.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of Louisiana, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration in Lafayette, Louisiana, except that either party may seek injunctive relief in court for intellectual property disputes or to protect user data.
